Welcome to Octubots. By accessing or using our services at octubots.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

1. Services

Octubots provides personal AI agent services, including but not limited to:

• Custom AI agent deployment on WhatsApp, Telegram, and other platforms.
• VPS hosting for your dedicated AI agent.
• Agent configuration, training, and ongoing support.
• Integration with third-party APIs (OpenAI, image generation, voice, etc.).

2. Account Registration

To use our services, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

3. Subscription Plans & Billing

• Services are provided on a subscription basis (monthly or yearly).
• Payments are processed securely through Stripe.
• Yearly plans include a discount and are billed upfront.
• One-time setup fees (e.g., installation) are non-recurring and charged at the start of your subscription.
• Prices are listed in USD and may be updated with 30 days’ notice.

4. Cancellation & Refunds

• You may cancel your subscription at any time from your dashboard.
• Monthly subscriptions: Cancellation takes effect at the end of the current billing cycle. No partial refunds.
• Yearly subscriptions: Refunds are available within the first 14 days if no agent has been deployed. After deployment, no refunds are issued.
• One-time fees (installation, setup) are non-refundable once the service has been delivered.

5. Acceptable Use

You agree not to use our AI agents for:

• Spam, harassment, or any illegal activity.
• Impersonation or misleading communications.
• Distributing malware or harmful content.
• Violating the terms of connected platforms (WhatsApp, Telegram, etc.).

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

6. Intellectual Property

All Octubots branding, technology, and content remain our property. Your agent configuration and custom data remain yours. You grant us a limited license to use your data solely to provide our services.

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by third-party services or force majeure events.

8. Limitation of Liability

Octubots is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

9. Privacy

Your use of our services is also governed by our Privacy Policy. By using Octubots, you consent to our data practices as described therein.

10. Changes to Terms

We may modify these Terms at any time. Significant changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the United Kingdom. Any disputes shall be resolved through arbitration in London, UK.
